Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • KMS Apeldoorn: KMS Apeldoorn, established in Apeldoorn, Chamber of Commerce number 66218393, VAT number NL856533346B01.
  • Customer: any natural person or legal entity that enters into an agreement with KMS Apeldoorn.
  • Service: the revision, repair or inspection of automotive electronics.
  • Repair order: the written or digital instruction to carry out a service.

Article 2 – Applicability

These terms and conditions apply to all quotations, agreements and service deliveries by KMS Apeldoorn. Deviations are only valid if agreed in writing. The applicability of any purchasing or other conditions of the customer is expressly rejected.

Article 3 – Offer and agreement

All offers from KMS Apeldoorn are non-binding and valid for 30 days, unless otherwise stated. An agreement is established when KMS Apeldoorn confirms an order in writing or digitally, or commences execution.

Article 4 – Prices and payment

All prices are inclusive of VAT, unless otherwise stated. KMS Apeldoorn uses fixed prices per repair, communicated via the website or quotation. Payment must be made within 14 days of the invoice date. If the payment deadline is exceeded, the customer is automatically in default and KMS Apeldoorn is entitled to charge statutory interest and collection costs.

Article 5 – Execution of the service

KMS Apeldoorn carries out the work to the best of its knowledge and ability. Stated delivery times are indicative. KMS Apeldoorn is entitled to have the work carried out by third parties. KMS Apeldoorn is not liable for delays outside its sphere of influence.

Article 6 – Warranty

KMS Apeldoorn provides a 24-month warranty on parts and labour for all repairs and revisions, from the date of return. The warranty lapses if:

  • The unit has been opened or altered by third parties after repair.
  • There is mechanical damage or incorrect installation.
  • The fault is the result of moisture damage, fire or improper use.

Article 7 – Liability

The liability of KMS Apeldoorn is limited to the amount of the invoice concerned. KMS Apeldoorn is never liable for consequential damage, loss of profit or indirect damage. KMS Apeldoorn is not liable for damage arising from the customer providing incorrect or incomplete information.

Article 8 – Intellectual property

All documents, reports, software and other materials provided by KMS Apeldoorn remain the property of KMS Apeldoorn and may not be reproduced or published without written permission.

Article 9 – Complaints

Complaints about work carried out must be submitted in writing or by email to KMS Apeldoorn within 14 days of discovery. After this period, the right to complain lapses. KMS Apeldoorn aims to handle complaints within 10 business days.

Article 10 – Right of retention

KMS Apeldoorn has the right to retain the repaired unit until the customer has fully paid all outstanding amounts.

Article 11 – Applicable law and disputes

All agreements with KMS Apeldoorn are governed exclusively by Dutch law. Disputes are preferably resolved by mutual agreement. If this fails, disputes will be submitted to the competent court in the Gelderland district.

Article 12 – Amendments

KMS Apeldoorn reserves the right to amend these terms and conditions. The most up-to-date version is always available on our website.
